First off, what's DMCA?
Secondly, who the hell are these people and why did they copy your EXACT site design and logo!?

I think you should slap a copyright on it and file a suit.

DMCA is Digital Millennium copyright Act and it's the legal authority at which I hold to file a complaint to their upstream provider which tells them that they have 24 hrs to remove said content or be slapped with a lawsuit and possible criminal charges if not complied to.

Basically it's what companies do to those stealing their stuff (example: Motion Pictures Association of America and the Recording Industry Association of America send you these if you get caught for downloading stuff only theirs contain suits)

We will be working on legal issues.

The design is Copyrighted and is solely Host Mist's.

We require that all alleged copyright violations be removed from the website in question and the onus is on the infringer to locate and remove all alleged copyright violations of the complainant’s intellectual property.

Very nice... clean and professional!
Funny thing is; even a Creative Commons Strict license would hold enough right to file a suit. I'm going to switch Wabuf to completely CC Strict as soon as our copyright is up. This is because I could care less if someone took my designs; heck, I make completely new designs once if not, twice a year and maybe they'll learn a thing or two from it. Plus, with the CC being strict, they must display my name and link somewhere on the page.

Finally design was taken down. Now the fun part, 14 days for a counter complaint and if one comes, I get to setup a legal battle.
